Terms of Service

These Terms govern your use of Fanout. By creating an account or using the service, you agree to them.

1. What Fanout is for

Fanout is a tool for sending your own legitimate outreach through your own Gmail account. You may use Fanout only to contact recipients you have identified yourself, and only when you have a legitimate business reason to contact them — for example, a prior business relationship, an inbound inquiry, a relevant professional connection, or contact details the recipient has made available for business outreach.

Fanout is not a contact-scraping service and is not a bulk unsolicited email tool. You may not use Fanout to email purchased lists, rented lists, scraped contact data, or any recipient you cannot honestly describe why you are contacting.

2. Prohibited uses

You may not use Fanout to send, compose, or facilitate any of the following:

Phishing of any kind, including messages designed to steal credentials, payment details, or personal information.

Impersonation of any person, brand, company, government body, or financial institution, including sending from or referring to identities you do not control or have no right to use.

Fraudulent or deceptive content of any kind, including false claims, fake offers, misleading sender information, or deceptive subject lines.

Content that violates CAN-SPAM, the GDPR, or any other applicable anti-spam or data protection law in the jurisdictions you or your recipients are in.

Harassment, threats, hate content, or any message intended to intimidate, abuse, or demean a recipient.

Any use that violates Google's Gmail API Terms of Use, Google's Acceptable Use Policy, or Google's program policies for email sending.

3. Your responsibility for content and recipients

You are solely responsible for the content of every message you send through Fanout, including base messages, edits, and approved drafts. You are also solely responsible for having a legitimate basis to contact each recipient on your lists, and for honoring opt-out and unsubscribe requests.

Fanout displays every generated message for your review and approval before sending. Your approval of a message is your decision to send it.

4. Suspension and termination

We reserve the right to suspend or terminate any account, without notice, if we reasonably believe it violates these Terms. Violations involving phishing or impersonation content are grounds for immediate termination. We may also suspend accounts we are required to suspend by law or by Google.

You may stop using Fanout and delete your account at any time. Sections 6 and 7 survive termination.

5. Sending through your Gmail account

Fanout sends email through the Gmail account you connect. You are responsible for complying with Google's Gmail API terms, Google's Acceptable Use Policy, and Google's sender guidelines, and for the state of your own Gmail account, including any limits Google applies to it.

6. No warranty on deliverability or sending limits

Fanout does not warrant deliverability, inbox placement, open rates, or any specific sending volume or limit. Email delivery and rate limits are ultimately controlled by Google and the recipient's mail provider, not by Fanout. Features such as daily caps and send windows are controls Fanout applies on your behalf; they do not guarantee that Google or any mail provider will deliver your messages.

7. Disclaimers and limitation of liability

Fanout is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, Fanout and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities, arising from or relating to your use of the service. Our total aggregate liability for any claim relating to the service is limited to the amount you paid us for the service in the twelve months before the claim arose.

8. Governing law

These Terms are governed by the laws of [Your jurisdiction], without regard to its conflict-of-law rules. Any dispute arising from these Terms or your use of Fanout will be subject to the exclusive jurisdiction of the courts of [Your jurisdiction].
